Resumen: Analizaremos un caso real en el que una madre y su hija de
tres años son atropelladas por una motocicleta al cruzar un paso de peatones regulado por semáforo. A su paso, el vehículo enganchó a la pequeña arrastrándola 17 metros, provocando su fallecimiento, y, en consecuencia, lesiones de tipo psicológico a la madre. Especialmente, se hace hincapié en la d e l i m i t a c i ó n d e l a p e n a l i d a d y e l t r a t a m i e n t o i n d e m n i z a t o r i o p o r responsabilidad civil dado tanto por el Juzgado como por la Audiencia Provincial.

Abstract: The article analyses a real case in which a mother and her
three-year-old daughter are run over by a motorcyclist while traversing a
pedestrian crossing regulated by a traffic light. It above all focuses on the
definition of the penalty and how the compensation on grounds of civil liability was calculated by both the civil and the provincial court.
